1. Acceptance of Terms
By accessing or using Building Certifiers Hub (“the Website”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Website. We may update these Terms from time to time — continued use after changes are posted constitutes acceptance of the updated Terms.
2. About the Service
Building Certifiers Hub is an online directory that helps homeowners, builders, and developers find licensed Australian building certifiers. We compile certifier information from public sources and provide tools for certifiers to claim and manage their profiles.
Data sourced from state and territory building practitioner registers. We are not affiliated with, endorsed by, or connected to any state building authority or the Australian Government in any capacity.
3. Content Accuracy and Limitations
While we make reasonable efforts to ensure the accuracy of information on the Website, we do not guarantee that certifier listings, contact details, service descriptions, or other information is complete, current, or error-free. Specifically:
- Licensing status is periodically verified against the state register but may not reflect real-time changes. A certifier shown as licensed on this Website may have had their licence suspended or revoked since our last verification.
- Certifier profiles are compiled from multiple public sources and may contain outdated or incomplete information, including AI-generated service descriptions.
- ABN data is sourced from the Australian Business Register. ABNs are public information used to identify business entities.
Users should independently verify a certifier's current licensing status with the relevant state building authority (e.g. QBCC, NSW Fair Trading, VBA) before engaging their services.
4. No Professional Advice
The Website provides a directory service only. Nothing on the Website constitutes building, legal, or professional advice. Users are responsible for conducting their own due diligence when selecting a building certifier and should seek independent professional advice where appropriate.
5. User Enquiries
Users may submit enquiries to building certifiers through the Website. By submitting an enquiry, you acknowledge that:
- Your contact details (name, email, phone number) and message will be forwarded to the selected certifier
- We cannot guarantee a response from the certifier or the quality of any services they provide
- Any engagement with a certifier is a direct relationship between you and the certifier — Building Certifiers Hub is not a party to that arrangement
6. Reviews
6.1 Submitting Reviews
Users may submit reviews of building certifiers listed on the Website. By submitting a review, you:
- Confirm that your review is truthful, based on genuine experience with the certifier, and reflects your honest opinion
- Grant us a non-exclusive, royalty-free, perpetual licence to publish, display, reproduce, and distribute your review on the Website and in related marketing materials
- Acknowledge that your review will be publicly visible on the certifier's profile page, attributed to the name you provide
- Acknowledge that we may edit, moderate, or remove reviews at our discretion
6.2 Review Guidelines
Reviews must comply with the following guidelines. Reviews that violate these guidelines may be removed without notice:
- Reviews must relate to a genuine building certification business experience with the listed certifier
- Reviews must not contain false, misleading, or defamatory statements
- Reviews must not include obscene, threatening, discriminatory, or offensive language
- Reviews must not contain spam, commercial solicitations, or links to external websites
- Reviews must not infringe intellectual property rights or disclose another person's private information
- Certifiers must not review their own business or submit fake reviews about competitors
- Reviews must comply with all applicable laws, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010)
6.3 Review Moderation
We reserve the right to review, edit, or remove any user-submitted content at our sole discretion. We are not obligated to publish every review. Certifiers who believe a review is false or defamatory may report it for review via their dashboard or by contacting us.
7. Certifier Accounts and Profile Claims
7.1 Claiming a Profile
Licensed building certifiers may claim their profile on the Website. The claim process requires:
- A valid business email address associated with the certification business
- Verification that the claimant is authorised to represent the certification business listed on the state register
We reserve the right to reject or revoke a profile claim if we reasonably believe the claimant is not authorised to represent the listed certification business.
7.2 Certifier Responsibilities
Certifiers who claim their profile are responsible for:
- Maintaining accurate, current, and not misleading profile information
- Securing their account credentials and notifying us of any unauthorised access
- Responding to user enquiries in a professional and timely manner
- Complying with all applicable Australian laws and regulations, including state building legislation and the Australian Consumer Law
- Ensuring any information published on their profile does not infringe third-party intellectual property or privacy rights
8. Subscription Services and Billing
We offer paid subscription tiers for certifiers, including Verified Badge and Featured Listing upgrades. By subscribing to a paid tier:
- You agree to pay the fees specified at the time of purchase, as displayed on the pricing page
- Payments are processed securely by Stripe. We do not store your payment card details
- Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date
- You may cancel your subscription at any time through the certifier dashboard billing portal. Cancellation takes effect at the end of the current billing period — no prorated refunds are issued for partial periods
- We reserve the right to change subscription pricing with 30 days' notice. Existing subscribers will be notified of price changes before their next renewal
Subscription features (badge display, listing priority, enhanced profile options) are described on the pricing page and may be updated from time to time.
9. Prohibited Conduct
You must not use the Website to:
- Scrape, crawl, or systematically collect data from the Website without our written permission
- Impersonate a building certifier or falsely claim a certifier profile
- Submit false, misleading, or fraudulent enquiries or reviews
- Interfere with the Website's operation, security, or other users' experience
- Use the Website for any unlawful purpose or in violation of any applicable law
10. Intellectual Property
The Website's design, code, branding, and original content are protected by copyright and are owned by or licensed to us. Certifier data sourced from public government registers is used in accordance with applicable government data licensing terms. AI-generated certifier descriptions are original works created by us.
You may not reproduce, distribute, or create derivative works from the Website's content without our written permission, except for personal, non-commercial use of individual certifier listings.
11. Links to Third Parties
The Website may contain links to external websites, including certifier websites, government registers, and payment processors. We are not responsible for the content, accuracy, or practices of third-party websites and do not endorse any linked site.
12. Limitation of Liability
To the maximum extent permitted by law, Building Certifiers Hub and its operators are not liable for:
- Any loss or damage arising from reliance on information published on the Website, including certifier listings, reviews, and contact details
- The actions, services, quality, or conduct of building certifiers listed on the Website
- Any indirect, incidental, special, or consequential damages arising from use of the Website
- Service interruptions, data loss, or security breaches beyond our reasonable control
- Any dispute between a user and a building certifier arising from an enquiry or engagement facilitated through the Website
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian law, including consumer guarantees under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).
13. Indemnification
You agree to indemnify and hold harmless Building Certifiers Hub and its operators from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your use of the Website, your violation of these Terms, or your infringement of any third-party rights.
14. Termination
We reserve the right to suspend or terminate access to the Website, or to deactivate any certifier account, for any user who violates these Terms. We may also remove content or restrict functionality without prior notice where we reasonably believe a violation has occurred.
15. Governing Law
These Terms are governed by the laws of the Commonwealth of Australia and the State of New South Wales. Any disputes arising under or in connection with these Terms will be subject to the non-exclusive jurisdiction of the courts of New South Wales.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
